Terms for the Provision of Electronic Services

These Terms govern use of the website, contact forms, mediation submissions, qualification for online consultations and other services provided electronically by WILIŃSKI LEGAL.

1. Service provider

The service provider is Kancelaria Adwokacka Tomasz Wiliński, ul. Krucza 16/22, 00-526 Warsaw, NIP 5992888071, attorney registration WAW/Adw/6392, e-mail: adwokat@tomaszwilinski.eu, tel. +48 518 687 082.

2. Scope of electronic services

The website enables, in particular: viewing informational content; sending a contact form; submitting a matter for an online consultation; submitting a matter for mediation; receiving organisational information concerning the date, fee and method of providing a service; and, after an appropriate payment provider has been implemented, making online payment for an agreed service.

3. Technical requirements

To use the website you need a device with Internet access, a current web browser and access to e-mail; for an online consultation, you also need a device with a microphone and a connection capable of transmitting audio and, where agreed by the parties, video.

4. Security

Users should use current software, protect access to their e-mail account and device, and avoid sending documents through unsecured channels. At the preliminary qualification stage, complete case files or information going beyond what is necessary to assess whether the firm can accept the matter should not be sent.

5. Prohibited unlawful content

Users may not transmit unlawful content, malware or content infringing third-party rights through the website, nor use the forms in a way that disrupts operation of the website.

6. Forms and acceptance of a matter

Submitting a form initiates contact with the Firm but does not constitute a legal-services agreement, acceptance of a mandate or creation of a power-of-attorney relationship. Before accepting a matter, the Firm may conduct a conflict-of-interest check and request additional information.

7. Online consultation

After a positive qualification, the client receives information about the scope of the consultation, fee, date and method of payment. A paid consultation agreement is concluded in the manner stated in the confirmation sent to the client, after acceptance of the terms and, where required, payment. The consultation covers only matters agreed before the meeting or capable of being reliably addressed within the scheduled consultation time.

8. Online mediation

Submitting a mediation form is a submission of the matter and does not automatically commence mediation. The rules on voluntariness, consent of the other party, costs and organisational procedure are described on the Mediation page.

9. Payments

Where online payment is available, it is processed by the designated payment operator. Before payment, the client receives information about the full price or the method used to calculate it. The Firm does not request payment-card details in an ordinary contact form or by e-mail.

10. Complaints

Complaints concerning operation of the website or an electronic service may be sent to adwokat@tomaszwilinski.eu. The submission should make it possible to identify the service and the problem. Consumer complaints are handled in accordance with Article 7a of the Polish Consumer Rights Act: unless separate provisions state otherwise, the Firm responds within 14 days after receiving the complaint; failure to respond within that time means the complaint is deemed accepted, and the response is provided on paper or another durable medium. Other complaints are handled without undue delay.

11. Consumers

If a user is a consumer and concludes a distance contract, the Polish Consumer Rights Act applies. Detailed information, including the right of withdrawal and commencement of performance before the withdrawal period expires, is available on the Consumer Information page.

12. Ending use of a service

A user may stop using the free functions of the website at any time. Termination or cancellation of a paid agreement takes place under its terms and applicable law, taking account of work already performed.

13. Professional secrecy and privacy

Use of electronic services does not exclude the Firm's duties concerning professional secrecy, confidentiality and personal-data protection. Data-processing rules are described in the Privacy Policy.

14. Amendments to the Terms

These Terms may be amended because of changes in law, service-delivery methods or technical solutions. Agreements already concluded remain subject to the rules applicable to the relevant relationship, with due respect for acquired rights and mandatory law.
