Distance contracts

Consumer Information

The information below concerns a consumer, meaning a natural person entering into a contract with the Firm for a purpose not directly related to their business or professional activity. To the extent provided for by the Polish Consumer Rights Act, relevant provisions also apply to a natural person concluding a contract directly connected with their business activity where the contract is not of a professional nature for that person, in particular in light of the scope of activity disclosed in the Polish CEIDG register.

1. Trader

Kancelaria Adwokacka Tomasz Wiliński, ul. Krucza 16/22, 00-526 Warsaw, NIP 5992888071, attorney registration WAW/Adw/6392, adwokat@tomaszwilinski.eu, +48 518 687 082.

2. Main characteristics of the service

Before a paid contract is concluded, the client receives a description of the service, its scope, the price or method of calculating the price, the date or method of agreeing the date, the method of communication and information about any conditions for commencing performance.

3. Price and payment

The total price including applicable taxes is provided before the contract is concluded. Where the nature of the service makes it impossible to determine the price in advance, the client receives the method for calculating it. Payment is made by a method agreed with the Firm or through the designated payment operator.

4. Right of withdrawal

As a rule, a consumer who concludes a distance contract may withdraw from it within 14 days from the date of conclusion without giving a reason, subject to the exceptions provided for by law.

5. Starting the service before 14 days have elapsed

If the consumer wants a paid consultation or another service to begin before the distance-contract withdrawal period expires, the Firm requires an express request to begin performance before that period ends and an acknowledgement that the consumer has been informed that the right of withdrawal will be lost once the service has been fully performed. If the consumer withdraws after performance has begun but before it is completed, the consumer is required to pay for the services provided up to the time of withdrawal, in proportion to the scope of performance, under the rules laid down by law.

6. Loss of the right of withdrawal after full performance

The right to withdraw from a paid services contract does not apply after the service has been fully performed where performance began with the consumer's prior express consent and, before performance began, the consumer was informed that the right of withdrawal would be lost after full performance and acknowledged that information.

7. How to withdraw

A withdrawal statement may be sent to adwokat@tomaszwilinski.eu or by post to the Firm's address. It is sufficient to send the statement before the deadline expires. The template below may be used but is not mandatory.

Model withdrawal statement

Addressee: Kancelaria Adwokacka Tomasz Wiliński, ul. Krucza 16/22, 00-526 Warsaw, adwokat@tomaszwilinski.eu.

I hereby give notice that I withdraw from the contract for the following service: [description]. Date of contract: [date]. Consumer's full name: [details]. Consumer's address: [address]. Date: [date].

8. Complaints

Complaints concerning performance of a service may be submitted to adwokat@tomaszwilinski.eu. It is helpful to identify the service, date and briefly describe the complaint. Unless separate provisions state otherwise, the Firm responds to a consumer complaint within 14 days of receipt. Failure to respond within that time means that the complaint is deemed accepted. The response is provided to the consumer on paper or another durable medium.

9. Out-of-court dispute resolution

After the complaint procedure has been exhausted, a consumer may, where the statutory conditions are met, use the out-of-court consumer dispute-resolution mechanisms provided for by law. Current information about available bodies and procedures is published by the Polish Office of Competition and Consumer Protection (UOKiK).

Urgent service and the right of withdrawal

If the consultation is to take place before the 14-day withdrawal period expires, the required statements concerning early commencement of performance and the consequences of full performance will be made at the stage of entering into the paid contract — not in the preliminary qualification form.
